Domaininhaber von cn-Domains werden in den nächsten Tagen eine Nachricht mit dem folgendem oder Inhalt erhalten (siehe unten).

Im Prinzip geht es darum, dass die chinesische Registrierungsbehörde unter Umgehung der Registrare eine Nachricht direkt an die Eigentümer von cn-Domains sendet mit der Aufforderung, auf einen Bestätigungslink zu klicken um die Identität des Eigentümers zu verifizieren. Dies muss innerhalb von 15 Tagen geschehen, ansonsten behält sich die CNNIC weitere Schritte vor, die letztendlich auch zum Verlust der Domain führen könne.

Auf Deutschland übertragen wäre dies genauso als würde die Denic eine Email direkt an die Webmaster senden, mit der Bitte einen Bestätigungslink zu klicken oder die Domain wäre weg. Kommuniziert wurde dies (wie so oft von chinesischen Behörden) schlecht oder überhaupt nicht, Webmaster und Registrare wurden vorher nicht informiert und von dieser Aktion überrascht.

Wer bereits eine Domain besitzt muss darüber hinaus nachweisen, dass er diese nicht innerhalb Chinas hostet bzw. die Domain keinen Inhalt enthält, falls sie außerhalb Chinas gehostet wird.

Inhaber von cn-Domains tun also gut daran, ihre Kontaktdaten zu überprüfen. Die Registrare haben keine Möglichkeit, diese Bestätigungsemail noch einmal zu versenden, falls ein Domaininhaber diese nicht empfangen hat.

Wenn man mich fragt, wie kompliziert es ist, in China eine Firma zu registrierten, sage ich scherzhaft immer: In Deutschland hat es 30 Minuten gedauert, in China 3 Monate. Der Vergleich hinkt natürlich, weil ich in Deutschland mit der GbR eine sehr unkomplizierte Rechtsform gewählt habe. Die Registrierung einer GmBH ist in Deutschland auch aufwändiger. Egal.

Ich habe mir heute noch einmal den aktuellen Stand angesehen, was man benötigt, wenn man eine Wholly Foreign Owned Enterprise in Peking registriert. Dann habe ich mir die Liste angeschaut. Was bekommt man eigentlich an Dokumenten von den Bürokraten zurück?

Wenn man das vergleicht, was die Anzahl der Dokumente bzw. Stempel angeht, nicht mal unbedingt ein Verlustgeschäft.

Also, die folgenden Dokumente muss man vorbereiten:

  1. Name Reservation Form
  2. Application Letter
  3. Articles of Assoctiation
  4. List of Directors /Shareholders
  5. Office Lease Agreement (ok, da braucht man auch einige Dokumente, die der Vermieter vorbereiten muss, ich zähls mal als eines)
  6. Notarized Certificate of Incorporation bzw. Handelsregisterauszug
  7. Passport of WFOE Direcor(s)
  8. Bank Reference Letter
  9. Application Form
  10. Power of Attorney (d.h. Vollmacht für den Rechtsanwalt)
  11. Resume of Legal Representative / Chairman of the Board
  12. Letter of Appointment for legal help für den Anwalt
  13. Inventarliste (manchmal)
  14. Kontaktdaten des Supervisors der WFOE (Name, Vorname, ID, Adresse)

Das habe ich zurückbekommen bzw. diese Dokumente und Stempel musste ich dann in meinem Safe aufbewaren oder an die Wand hängen.

knappes Ergebnis: 16 : 14 für die Bürokraten. Der Aufwand lohnt sich also.
